Flynn was charged with lying to the FBI when the ambush interviewed him, lying to him about the nature of the interview and ensuring that he didn't have a lawyer present. Allegedly Flynn lied about whether or not he'd discussed sanctions with the Russian Ambassador.
We've known for a long time that the agents who interviewed him didn't think Flynn was lying. But now we know that it was literally impossible for him to have lied.
It turns out that Flynn never said that he didn't talk to the Russian about sanctions. The FBI notes say that Flynn said that he didn't remember talking to the Ambassador about sanctions but that he could have.
The prosecution hid that from the court.
The prosecution also hid the fact that they told Flynn that if he didn't plead guilty they'd go after his son on bogus charges.
Other material that indicated that the FBI was out to entrap Flynn was also concealed.
And the DOJ continued to hide this information despite Sullivan's orders to produce any Brady evidence, ie any exculpatory evidence.
But worst of all the FBI had no basis to question Flynn. Since we're not living in a police state, despite Democrat politicians best efforts, the FBI can't just randomly question people and then throw them in jail if they don't like the answers they get. There has to be an investigation that justifies the FBI knocking on your door.
The FBI had started an investigation into Flynn and found absolutely no evidence he'd done anything wrong. They were going to close the case when Peter Strzok, the guy we know conspired to undo the 2016 election, made them keep it open. Just because Flynn was associated with Trump and Strzok wanted to get Trump.
That's what secret police do in fascist regimes not what the FBI is supposed to do in America.
With all of this information now available the DOJ did the right thing and dropped the charges. Keep in mind if the same information was found in a drug dealers trial the charges would be dropped as well.
Yet judge Sullivan has called in a former judge who just wrote an editorial in the Washington Post that sullieffectively says that due process, rule of law, and the need for prosecutors to be honest only applies to murders, rapists, and terrorists not to Republicans to defend a continued prosecution of Flynn; something that would never happen in a criminal case.
In earlier parts of the trail when people wanted to present arguments to the court in defense of Flynn Sullivan refused to allow them to do so. But now he's clearly desperately trying to punish Flynn for the crime of not being a Democrat.
The former judge, Emmet G. Gleeson, has worked closely in the past with Andrew Weissman a hardcore Trump hater who worked on Mueller's investigation.
Gleeson has shown a great deal of sympathy for criminals in the past. Going so are as to ask prosecutors to vacate convictions that he'd been forced to impose--due to minimum sentencing laws.
But now he's hell bent on ensuring that Flynn go to prison despite gross and illegal prosecutorial misconduct.
